1. About these Terms


These Terms of Service (“Terms”) govern your access to and use of our website and portal at www.todesdance.ae (the “Website” and “Portal”) and the fine arts training services provided by TODES Dance Center (the “Studio”, “we”, “us”, “our”), including trial classes, memberships, packages, workshops, events, and related services (the “Services”).

By accessing the Website/Portal, submitting an application, booking a class, purchasing a membership/package, or attending the Studio, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Website/Portal or Services.

2. Definitions


  • Student: any person attending Services, including minors.
  • Parent/Guardian: a legal parent or guardian of a minor Student.
  • Member: a Student with an active membership or package.
  • Booking: any reservation for a class, trial, workshop, event, or service.
  • Fees: all prices, charges, and amounts payable for Services.
  • Rules: Studio rules and policies published on the Website/Portal, in-studio, or communicated by the Studio.



3. Eligibility and minors


3.1 Adults. If you are 18 or older, you may register and purchase Services.
3.2 Minors. If the Student is under 18, a Parent/Guardian must:

  • register and provide consent on behalf of the Student;
  • confirm the Student’s accuracy of information (including medical/safety information);
  • accept responsibility for compliance with these Terms and Rules.
  • 3.3 Authority. By registering a minor, you confirm you have legal authority to do so.



4. Services, schedules, and changes


4.1 Programs and levels. Services include training programs for Kids, Teens and Adults, and may include classes in various styles, rehearsals, performances, and events.
4.2 Schedule changes. Schedules, instructors, class formats, and studio rooms may change due to operational reasons. We may substitute instructors or reschedule classes without liability.
4.3 Cancellations. We may cancel classes due to safety, facility issues, instructor illness, low attendance, or force majeure. In such cases, we will offer a make-up class, credit, or other remedy as determined by the Studio in good faith.


5. Registration, accounts, and communications


5.1 Accurate information. You must provide accurate, current information and keep it updated.
5.2 Portal access. You are responsible for safeguarding your login credentials and all activities under your account.
5.3 Communications. We may communicate with you via email, phone, WhatsApp, or Portal notifications for service-related purposes (bookings, changes, safety). Marketing communications are subject to your preferences and applicable law.


6. Health, safety, and assumption of risk


6.1 Physical activity. Dance and fitness-related activities carry inherent risks including strain, injury, or other harm. By participating, you acknowledge and accept these risks.
6.2 Medical readiness. You confirm that the Student (or you) is medically fit to participate. If you have a condition, injury, or limitation, you must inform us before participating.
6.3 Studio instructions. You must follow instructor and staff instructions, safety protocols, and Rules at all times.
6.4 Emergency. In an emergency, you authorize the Studio to seek reasonable medical assistance. You are responsible for associated costs.


7. Conduct and studio rules


7.1 Respect and behavior. Disruptive, unsafe, abusive, discriminatory, or inappropriate behavior is not allowed.
7.2 Right to refuse service. We may refuse entry, suspend, or terminate access to Services without refund where serious misconduct occurs, to protect Students, staff, or property.
7.3 Dress code and hygiene. Appropriate dancewear and footwear may be required.
7.4 Personal belongings. You are responsible for your belongings. We are not liable for loss or theft to the maximum extent permitted by law.


8. Bookings, payments, pricing


8.1 Prices. Prices are displayed on the Website/Portal or communicated by the Studio. Prices may change at any time, but changes will not affect already-paid bookings unless required by law.
8.2 Payment. Fees must be paid in advance unless otherwise agreed.
8.3 Taxes. Fees may include or exclude applicable taxes depending on how pricing is displayed.
8.4 Failed payments. If payment fails or is reversed, we may suspend Services until resolved.
8.5 No chargebacks abuse. Unauthorized chargebacks may result in account suspension and recovery actions.


9. Memberships, packages, and validity


9.1 Validity. Memberships and packages have validity periods and usage rules specified at purchase. Unused classes may expire.
9.2 Non-transferable. Memberships/packages are non-transferable unless the Studio approves in writing.
9.3 Freeze (if offered). Freezes may be allowed under specific conditions and time limits communicated at purchase or in Rules.


10. Cancellation, rescheduling, and refunds


This section is intentionally protective for the Studio; adjust if you want more “customer-friendly”.

10.1 Student cancellations. If you cancel or miss a class, no refund is provided unless required by law. Where we allow rescheduling, it must be done within the timeframe and rules communicated by the Studio.
10.2 Trial classes. Trial classes are non-refundable once booked, except where required by law or where the Studio cancels.
10.3 Workshops/events. Workshops, intensives, and events may be non-refundable due to limited capacity. Specific terms will be shown at checkout or booking.
10.4 Studio cancellations. If we cancel a class/session, we will offer a make-up, credit, or other remedy at our discretion.
10.5 Refund method. Any approved refunds are issued to the original payment method where possible and may take time to process.
10.6 Exceptional cases. We may consider exceptions (for example, documented medical reasons) strictly at our discretion.


11. Photos, video, and media consent


11.1 General. We may capture photos/videos in the Studio or during performances/events for training analysis, quality, and promotional purposes.
11.2 Consent for minors. For minors, Parent/Guardian consent may be required depending on context.
11.3 Opt-out. You may request not to be photographed/filmed by contacting us. We will make reasonable efforts to honor this request; however, we cannot guarantee exclusion from all background footage during public events.
11.4 User recordings. Recording classes may be restricted. Ask staff before filming.


12. Intellectual property


12.1 Studio IP. All Website/Portal content, branding, logos, choreography (to the extent protectable), class materials, videos, and other content are owned by or licensed to the Studio and are protected by applicable laws.
12.2 No copying. You may not reproduce, distribute, modify, scrape, or commercially exploit our content without written permission.
12.3 Limited license. We grant you a limited, non-exclusive, non-transferable license to access the Website/Portal for personal, non-commercial use.


13. User content and submissions


13.1 Your content. If you submit content (messages, feedback, media) you confirm you have rights to do so.
13.2 License. You grant the Studio a worldwide, royalty-free license to use such content to operate, improve, and promote Services, unless you explicitly request otherwise and we agree in writing.
13.3 Prohibited content. You must not submit unlawful, defamatory, abusive, or infringing content.


14. Disclaimers


14.1 No guarantees. Results depend on individual factors (attendance, fitness, effort). We do not guarantee outcomes.
14.2 Website availability. The Website/Portal is provided “as is” and “as available”. We do not guarantee uninterrupted or error-free operation.


15. Limitation of liability


To the maximum extent permitted by applicable law:
15.1 The Studio is not liable for indirect, incidental, special, consequential or punitive damages, or loss of profits, data, or goodwill.
15.2 The Studio’s total liability arising out of or related to Services or these Terms will not exceed the total Fees paid by you for the relevant Services in the 3 months preceding the event giving rise to the claim (or another cap set by law).
15.3 Nothing in these Terms excludes liability that cannot be excluded under applicable law.


16. Indemnity


You agree to indemnify and hold harmless the Studio, its staff, and affiliates from claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • your breach of these Terms or Rules;
  • your misuse of the Website/Portal;
  • your violation of law or third-party rights;
  • your content submissions.



17. Force majeure


We are not responsible for failure or delay caused by events beyond reasonable control, including acts of God, government actions, mall/building restrictions, power or internet outages, pandemics, extreme weather, or other force majeure events. We may reschedule or offer credits at our discretion.


18. Suspension and termination


We may suspend or terminate your account or access to Services immediately if we reasonably believe you breached these Terms, violated safety Rules, engaged in misconduct, or created risk to others. Where appropriate, we may provide notice. Refunds are not guaranteed and may be denied where termination is due to misconduct.


19. Governing law and jurisdiction


These Terms are governed by the laws of the United Arab Emirates and, where applicable, the laws and regulations in force in the Emirate of Dubai. Any disputes shall be subject to the jurisdiction of the competent courts of Dubai, UAE, unless mandatory law requires otherwise.


20. Changes to these Terms


We may update these Terms from time to time. The updated version will be posted on the Website with an updated “Last updated” date. Continued use of the Website/Portal or Services after changes means you accept the revised Terms to the extent permitted by law.
